Unlawful announcement and promotion of SMDC pipeline projects on Digital Platforms
This is to notify that ALL SELLERS are PROHIBITED to develop websites and social media accounts announcing and promoting projects without license to sell (LTS).
Failure to comply with this memo will give SMDC the right to forfeit benefit, commissions, and use all legal procedures to penalize the initiator, the admin of the site/s and promoters. Sanctions as follows: (Disciplinary Procedures)
FIRST OFFENCE - P100,000.00 penalty for both Seller and Sales Director. (Total fine: P200,000.00) To be deducted from their commission.
SECOND OFFENCE
a. P500,000.00 penalty for Sales Director and
b. Termination of the Seller
For strict compliance, FINAL DEMAND is therefore made for the immediate deletion of all existing accounts bearing the foregoing.
Please note that the Real Estate industry is governed by the rules and regulations set by the HLURB. Hence, all materials used for the sales, marketing and promotions of products of SMDC and/or its affiliates must be with HLURB's approval through SMDC Marketing.
Marketing initiatives covered by HLURB include all DIGITAL efforts, thus:
Unauthorised websites, Facebook pages, Instagram, Twitter, Linked-in and other Social networking sites that bear SMDC's and/or its affiliates' brand logo and all its property logos and images must be immediately taken down and subjected to the review of SMDC Marketing. Such website or social media sites will be only allowed to be reposted once cleared by SMDC Marketing provided it is compliant with all HLURB regulations.
All websites and social media sites bearing SMDC's and/or its affiliates' names must likewise be taken down immediately and re-named to reflect the owner's name.
All websites and social media contents that bear statements that MISREPRESENT SMDC and/or its affiliates and mention promotions not sanctioned by the company, such as but not limited to a "RENT TO OWN" schemes will be subject to penalties.
Failure to comply with this Memo will result to:
Site owner to be reported to HLURB and will thus be liable to pay the commensurate penalties. (i.e P10,000 per unit x no. of units x no. of developments featured.)
Should the site caused SMDC and/or its affiliates to be sanctioned by HLURB, SMDC will terminate and use all other legal remedies available to SMDC and its affiliates; and forfeit any/all pending benefits and commissions to site owner.
